Cook Islands Court of Appeal decision in the Green Room case

The decision of the the Cook Islands Court of Appeal in the Green Room case (CA: 9/2015, 13 June 2016) has some potentially far reaching implications for the sale of businesses located on multiple leases from different landowners or commercial use leases that do not address covenants implied by section 106A of the Property Law Act 1952. If you think you may be affected by this decision (including landowner lessors where leases are being used for commercial purposes) we have lawyers available who can advise you on the legal position.
